MotionSense Wellness provides wellness programs and resources for employers and employees. You may use our Services only for lawful purposes and in compliance with these Terms. You agree not to misuse or interfere with our Services, attempt unauthorized access, or engage in activity that could damage or disrupt our systems or data.

Accounts and Registration
To access certain features, you may need to create an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. You agree to notify us immediately if you suspect unauthorized use of your account.

Subscriptions and Payments
Some Services are offered on a paid subscription basis. By subscribing, you agree to pay the applicable fees as outlined on our pricing page. Payments are processed securely through third-party providers. All fees are non-refundable except as required by law or explicitly stated otherwise. If you choose an invoice-based plan, payment terms will be outlined in your agreement with us. Failure to pay may result in suspension or termination of access to our Services.

Employer and Employee Use
Employers who purchase Services for their workforce are responsible for providing accurate employee information and for ensuring that their employees understand how to use the Services. MotionSense Wellness may provide aggregated and anonymized reporting to employers but will not share individual-level data without employee consent.

Intellectual Property
All content, materials, and software provided through our Services, including logos, text, graphics, and designs, are owned by MotionSense Wellness or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or use any of our intellectual property without prior written consent.

Our Services are intended to support wellness and healthy lifestyles but are not a substitute for medical advice, diagnosis, or treatment. Always seek the advice of a qualified healthcare provider with any questions you may have regarding a medical condition. MotionSense Wellness does not guarantee specific health outcomes or results from the use of our Services.

Limitation of Liability
To the fullest extent permitted by law, MotionSense Wellness, its affiliates, officers, employees, and partners shall not be liable for any indirect, incidental, special, or consequential damages arising out of or related to your use of our Services. Our total liability for any claim under these Terms is limited to the amount you paid for the Services in the twelve months preceding the event giving rise to the claim.
Termination
We may suspend or terminate your access to our Services at any time if you violate these Terms, misuse our Services, or if required by law. You may also stop using our Services at any time. Upon termination, your right to access our Services will cease immediately, though obligations related to payments, intellectual property, and liability limitations shall survive.

Governing Law
These Terms are governed by and construed under the laws of the Province of Nova Scotia, Canada, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Halifax, Nova Scotia.

We may update or modify these Terms from time to time. When changes are made, the “Effective Date” at the top will be updated. Continued use of our Services after changes are posted constitutes acceptance of the revised Terms.
